Moderation And Enforcement Policies

Songfork Moderation And Enforcement

This Content Moderation and Enforcement Policy (“Policy”) governs your use of the Songfork Platform. We encourage you to read this Policy carefully before using the Platform and to periodically review it throughout your usage.

Songfork does not act as a publisher of content on the Platform. Instead, we (i) store content and information at the direction and with the authorization of our users, (ii) function as a passive conduit and/or host for the uploading, storage, and distribution of such content, and (iii) do not play an active role in presenting or using the content.

While Songfork retains the right, but not the obligation, to review and moderate content on the Platform, we take action against content that is illegal or objectionable. For the purposes of this Policy, “moderate” refers to actions taken, either automatically or manually, to identify or address illegal content, content that breaches our Terms, or other objectionable activity. For clarity, Songfork does not actively monitor content or the Platform.

  • General Provisions
Songfork utilizes a variety of automated processes and techniques to address illegal and objectionable content on our Platform. During the sign-up process, you must agree to our Terms of Use and Community Guidelines (collectively referred to as the “Terms”). These Terms clearly prohibit the upload of any illegal content or content that breaches the Terms.

All capitalized terms used in this Policy but not defined herein carry the same meaning as outlined in the Terms.

Before uploading content or interacting with other users, you must verify your email address. This step ensures that only genuine users engage with Songfork, reducing the risk of anonymous violations. We also recommend reviewing our Privacy Policy and Cookies Policy for more information on how we collect and utilize data related to your use of the Platform, as well as your rights concerning the processing of your personal data.
  • Content Moderation
At our discretion, Songfork may employ both automated and manual tools to detect and prevent objectionable content. This is accomplished through two primary methods:

    a. Detection of Violative Profile Names, URLs, and Descriptions: Words or phrases that breach our Terms are prohibited in profile names, descriptions, and URLs. Attempts to use such terms may result in automatic and permanent suspension from the Platform.

    b. Detection of Violative Audio, Images, and Track Data: We use a third-party vendor to proactively identify and remove violative uploaded content, including audio, images, and track data. Techniques such as image detection, audio matching, and text recognition are employed. Detected content may be flagged for review or automatically removed. Users whose content is flagged will receive a notification via their registered email, including reasons for the removal. Removed content may contribute to a user’s status as a Repeat Infringer, as detailed in section 5b.
  • Complaint Procedure and Decision-Making Process
Songfork operates a reporting and takedown process for content suspected of breaching our Terms or the law. Users are encouraged to report any instances of violative content or behavior on the Platform. Depending on your location, the complaint process can be initiated through dedicated report forms in our help center or report buttons available on content across our web and mobile applications.

Before initiating a complaint, we recommend reviewing the following resources to determine whether the content in question may be considered violative:
    • Terms of Use
    • Community Guidelines
    • Help Center Articles
  • All complaints are directed to our Trust & Safety Team for review. Our reporting options are user-friendly, and the complaint procedure is designed to be straightforward.

To expedite the reporting process, our notification form includes dropdown menus for different categories of violations. Please ensure your notice includes:
    • A sufficiently substantiated explanation of why you believe the information is violative.
    • A clear indication of the URL.
    • Your name and email address.
    • Confirmation that the information and allegations are accurate and complete.

    Insufficient notices will be rejected.

Upon submitting a complaint, you will receive a confirmation of receipt at the email address provided.

  • Complaint Review Process
When our Trust & Safety Team reviews reported content, they consider our Terms, Community Guidelines, and applicable law as relevant criteria.

Complaints and requests from law enforcement are prioritized and reviewed swiftly, including removal orders received from competent authorities.

We work with a third party to proactively detect problematic content. Content flagged through this solution is processed as described in section 2b. Complaints undergo a thorough review in accordance with our internal guidelines and legal requirements. For example, we aim to review unlawful content, such as terrorist content, within 24 hours of receiving a complaint (some exceptions may apply). Generally, decisions on content removal requests are made within one week, although occasional exceptions may occur.

When content is removed, the account holder will be notified with reasons for the removal and informed of their right to appeal (see section 6). If a complaint does not result in content removal, the complainant will receive written notice explaining the decision and their right to appeal.
  • Copyright Infringement
Please follow the instructions on our Copyright Information Pages.
  • Content and Profile Removals
Songfork reserves the right to block, remove, delete, limit, or restrict access to any content at any time, without liability. This includes content that infringes the rights of third parties or violates our Terms or the law. If we remove or restrict access to your content, we will notify you where required by applicable law and explain the reasons for our decision.

Uploaders have control over their audio content and may remove any or all audio content at any time without notice. You have no right to continued access to any content, and Songfork shall not be liable if you are unable to access content due to its removal.

If we become aware of any content that infringes third-party rights or violates our Terms or applicable law, we may take action such as sending a written warning or suspending or terminating your account.
  • Appeals
If content is removed or a suspension or termination occurs, you have the right to appeal the decision. We provide clear instructions on how to appeal in the written notice you receive during the complaints procedure.

Appeals are reviewed impartially, ensuring that no appeal is evaluated by the same party that made the initial decision. If your appeal is unsuccessful, we will explain the reasons. If successful, your content will be restored.

You may have additional appeal options, such as out-of-court dispute resolution or legal action. For more information, refer to the “Complaint Procedures” section in our Terms of Use.
  • Our Commitment to Human Rights
At Songfork, we strive to create a space that encourages and respects freedom of expression while safeguarding our users' safety and privacy. We invest resources into operationalizing our Content Moderation and Enforcement Policy, emphasizing easy reporting of objectionable content and the ability to appeal moderation decisions.

These efforts are part of our broader commitment to respecting the human rights outlined in the United Nations Guiding Principles on Business and Human Rights. While we work diligently to ensure that unlawful or objectionable content is addressed, we also value the diversity of music and content on Songfork. Our Community Guidelines are intended to guide users toward reasonable and respectful exchanges, promoting discussion and constructive criticism.
